Sexual crimes due to chemical submission are increasing.This is corroborated by victims and experts over the last months, when these types of crimes have jumped to public light.Many women do not know what to do or what steps to follow when they suspect that they have been victims of rape through this method.The majority that has gone through that experience and seeks help, ends up recounting a calvary of procedures, setbacks, insecurities and even abuse by units that should be perfectly coordinated to attend them with the greatest efficiency.But, on many occasions, the process ends up revictimizing them.Therefore, most women do not denounce these aggressions.

This was revealed this Wednesday a group of women who presented more than 100,000 signatures before the Ministry of Justice demanding that a clear and unified protocol that coordinates three legs is launched: the sanitary, the police and that of justice.

Muchas víctimas de violación por sumisión química no tienen siquiera claro lo que les ha pasado, por lo que tardan tiempo en reaccionar o buscar ayuda. En Público hemos querido poner blanco sobre negro algunas cuestiones relacionadas con este tipo de agresiones sexuales, así como dar respuesta a dudas que muchas víctimas necesitan conocer.

What is the violation by chemical submission?

Se trata de una agresión sexual en la que a la víctima se le ha suministrado algún tipo de droga o sustancia que la duerme o le impide tomar decisiones autónomas y consciente. Estas drogas no sólo la incapacitan para tomar decisiones, sino que en la mayoría de los casos impiden que tenga recuerdos de lo que ha vivido. Muchas mujeres que han sufrido este tipo de agresión manifiestan haber perdido la memoria durante unas horas, no recordar lo que ocurrió, o sólo tener algunos recuerdos o imágenes aisladas, conocidas como flashbacks.

Is it a consensual relationship?

No. En ningún caso el no poder negarse a una agresión por estar bajo los efectos de sustancias se puede considerar como una acto sexual consentido, porque la mujer no pudo dar su aprobación. Se trata de un delito penado por la ley. Sin embargo, el Código Penal no lo considera una agresión (lo que la mayoría de la gente entendería como violación), sino como un abuso sexual. Para que exista agresión sexual la norma exige que tiene que haber existido violencia o intimidación hacia la víctima y el Código Penal interpreta que en la agresión a un persona inhabilitada por los efectos de drogas, estas circunstancias no se producen.

Esta no es una pregunta baladí. La mayoría de las víctimas de este delito no tienen conciencia de qué les ha pasado. La acción de las drogas o sustancias suelen dejar lagunas de varias horas en el cerebro. Es habitual que se despierten en lugares o en condiciones que no saben explicar o con dolores corporales y vaginales para los que no tienen respuestas. Muchas no denuncias o lo hacen con retraso, porque no saben cómo explicar lo que les puede haber pasado. Saben que estaban en un sitio y que de repente todo se ha fundido a negro. Algunas afirman tener recuerdos fugaces o que estos recuerdos, conocidos como flashbacks aparecen con el tiempo o en terapias psicológicas específicas.

La recomendación de los expertos en violencias sexuales es que cuando una mujer tiene este tipo de lagunas, que normalmente no son compatibles con una simple borrachera, acudan de inmediato a un centro sanitario de referencia para estas violencias. Cuanto antes, mejor, porque las sustancias que provocan esta sumisión tienen un efecto rápido en el cuerpo, pero tienen se eliminan rápidamente. La recomendación es que pidan ayuda en antes de que transcurran más de 24 horas para que se puedan hacer las pruebas pertinentes que demuestren la presencia de tóxicos en el cuerpo y para que se realice un protocolo de posible abuso sexual, buscando pruebas que lo demuestren, como lesiones corporales o restos de semen el el cuerpo.

What do I have or do not have to do if I have suspicions?

Diversos expertos sanitarios en agresiones sexuales afirman a Público, que ante la sospecha, acudan cuanto antes a un centro médico de referencia. Entre las recomendaciones resaltan la importancia de no ducharse, no cambiarse de ropa interior, no enjuagarse la boca, ni lavarse los dientes. Allí pueden quedar restos de semen si hubiera habido un agresión sexual por vía oral o restos de la sustancia que ha provocado la sumisión química.

What happens if it takes a long time to realize and ask for help?

Many victims of this type of aggressions do not report it or come to ask for help for not being clear about what happened to them or for a deep sense of guilt.But various experts claim that the term "afternoon" is very relative.If the woman takes time to go to a court or a hospital, there are other tests that can be performed to determine if she suffered a chemical submission.

Entre ellas, analizar la existencia de hematomas en el cuerpo. Otra, tal vez menos conocida, es el análisis del cabello, pues ahí se acumula la sustancia y puede determinar si en un momento concreto se ha sido víctima de una sumisión. La recomendación es no cortarse el pelo y realizarse la prueba pasados entre uno o tres meses desde el momento en que se sospecha que ha sufrido la agresión. Esta prueba, si bien está en algunos protocolos médicos, no suele hacerse como rutina. En muchos casos las encargan los jueces para que sea realizada por forenses. Sin embargo, en muchas ocasiones los jueces no la piden por considerar, erróneamente, que ha transcurrido demasiado tiempo desde los hechos.

If I suspect that I have been a victim where?

Estas dudas y recuerdos fraccionados tienen como consecuencia que en muchas ocasiones los jueces no crean a la víctima, consideren que se inventa el relato o asumen que ha sufrido "una mala borrachera" y archiven las diligencias. La mayoría de víctimas de violencia sexual por sumisión química no están en condiciones de denunciar o de hacer una reconstrucción de los hechos poco después de ocurrir la agresión. En ocasiones, y gracias a la ayuda de psicólogos, algunas van recuperando recuerdos. Este cambio en las declaraciones tienen consecuencias negativas en los juzgados.

Recently, the Minister of Justice affirmed that work is being done in a common protocol at the national level for the collection of samples in crimes of rape and that will allow them to be collected even if the victim does not report or decide to do so later.These samples will remain in custody until the crime prescribes, thus giving the possibility to the victims to denounce when they are prepared to face a judicial process.But the measure has not yet been presented.

This is another problem.There is no accessible public information, brochures or guides that solve the doubts of a victim and many end up in a journey through health centers, hospitals, police stations ... A situation that, as Amnesty International denounced in a report entitled It is time for me toYou believe.A system that questions and unprotected the victims in 2018, is a revictimization of the victims.

Tampoco existen campañas informativas a nivel nacional o incluso regional que dejen claro los pasos a seguir si eres víctima de una violación por sumisión. Lo importante es conocer en su región o comunidad autónoma cuál es el centro de referencia hospitalario para este tipo de violencia y acudir lo antes posible. Los expertos reclaman que haya más formación de los Cuerpos de Seguridad del Estado, así como de los sanitarios, para identificar estas violaciones por sumisión y campañas de información hacia las víctimas.

The Ministry of Equality has launched the creation of those known as crisis centers against sexual violence.There will be one in each province and will attend, advise and support the victims without the need to file complaints.But its implementation is scheduled for 2023.​

How many women are victims of chemical submission?
